Perhaps in response to the Department of Justice threatening to go over his head to the Count of Appeals, Texas Trump Judge J. Campbell Barker who has been sitting on the FDA’s Congressionally-mandated cigarette pack graphic warnings for years has announced the he expects to rule on the industry’s challenge to the warning labels byContinue reading “After sitting on cigarette warning labels, judge announces he will rule on their legality (in a month)”

RJR promotes “ice” cigarettes to get around Calif flavored tobacco sales ban
In addition to suing California on a last ditch attempt to block California’s ban on sale of flavored tobacco products that was overwhelmingly endorsed by the voters, RJ Reynolds (BAT’s US subsidiary) has sent mailers to smokers promoting new “non-menthol” cigarettes that taste like menthol (pictures above). Desmond Jenson from the Public Health Law CenterContinue reading “RJR promotes “ice” cigarettes to get around Calif flavored tobacco sales ban”
Surprise! Reynolds & friends sue to block Calif flavored tobacco ban
Like clockwork the Big Tobacco (RJ Reynolds and others) sued California to block implementation of the state’s ban on the sale of flavored tobacco products (Proposition 31). This is not surprising since the tobacco companies have a long history of filing unsuccessful lawsuits to scare local and state governments and slow things down. Unlike normalContinue reading “Surprise! Reynolds & friends sue to block Calif flavored tobacco ban”
Regan-Udall Foundation review of FDA tobacco regulation “listening sessions” dominated by pro-industry speakers
Regan-Udall Foundation review of FDA tobacco regulation “listening sessions” dominated by pro-industry speakers The FDA has asked the Regan-Udall Foundation for recommendations on how to improve tobacco product regulation. The Foundation’s Tobacco Independent Expert Panel has had three “listening sessions” that have been dominated by industry players and “harm reduction” advocates. I have previously expressedContinue reading “Regan-Udall Foundation review of FDA tobacco regulation “listening sessions” dominated by pro-industry speakers“

DOJ urges Trump judge who has been sitting on FDA cigarette pack warning labels to act
A Trump judge in Texas has been sitting on a case the cigarette companies filed against the FDA’s mandated health warning labels for two years. By not acting, he has effectively blocked the labels nationally but, by not ruling, there has been nothing for the Justice Department to appeal. The DOJ filing (below) is finallyContinue reading “DOJ urges Trump judge who has been sitting on FDA cigarette pack warning labels to act”
Trump judge continues to delay cigarette warning labels by doing nothing
Last May a federal judge in Texas appointed by President Trump again delayed ruling on the tobacco companies’ lawsuit against the Congressionally-mandated warnings on cigarette packs that the FDA finally issued in 2020. Now he has done it again, pushing the rule’s effective date for the warning labels by an additional 90 days, to OctoberContinue reading “Trump judge continues to delay cigarette warning labels by doing nothing”
Massachusetts’ comprehensive flavor ban cut menthol sales by 96% and overall tobacco sales by 25%
While the FDA continues to dither on getting rid of flavored tobacco products, most notably menthol e-cigarettes, states and localities continue to move forward. The tobacco companies continue to argue that such bans don’t work and that people will just switch to other products. Melody Kingsley, Hannah McGinnes, and their colleagues at the Massachusetts DepartmentContinue reading “Massachusetts’ comprehensive flavor ban cut menthol sales by 96% and overall tobacco sales by 25%”
FDA should not grant exemptions to its proposed standard banning menthol in cigarettes that would continue to allow menthol heated tobacco products or low nicotine cigarettes
FDA’s proposed standard banning menthol in cigarettes is very well-done except for its provision that would allow FDA to exempt heated tobacco products like Philip Morris’ IQOS, BAT’s glo or JTI’s Ploom — which are considered “cigarettes” under the law — or low nicotine cigarettes. (FDA has only authorized sale IQOS so far.) This isContinue reading “FDA should not grant exemptions to its proposed standard banning menthol in cigarettes that would continue to allow menthol heated tobacco products or low nicotine cigarettes”
FDA should prohibit all menthol flavor additives, compounds, constituents, and ingredients in cigarettes, and should not limit the proposed standard to prohibiting menthol as a “characterizing flavor”
My colleagues at UCSF and other universities and I have submitted this comment to the FDA in response to its proposal to prohibit the use of menthol in cigarettes. A PDF of the comment is here. The Regulations.gov tracking number is l6b-ew3y-c1ye. FDA should prohibit all menthol flavor additives, compounds, constituents, and ingredients in cigarettes,Continue reading “FDA should prohibit all menthol flavor additives, compounds, constituents, and ingredients in cigarettes, and should not limit the proposed standard to prohibiting menthol as a “characterizing flavor””
